Please read these Terms of Service (“Terms”) carefully before using the Pikeah Chrome Extension and associated platform (the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By installing the Pikeah extension or creating an account, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Pikeah provides a browser-based automation tool designed to assist users with LinkedIn networking, lead generation, and message sequencing.

3. Relationship with LinkedIn (Crucial Disclaimer)

• Independent Entity: Pikeah is not affiliated with, endorsed by, or partnered with LinkedIn Corporation.
• Compliance Risk: LinkedIn’s User Agreement generally prohibits the use of third-party automation. By using Pikeah, you acknowledge that you are doing so at your own risk.
• No Liability for Account Actions: Pikeah is not responsible for any restrictions, suspensions, or permanent bans placed on your LinkedIn account. You are solely responsible for setting safe daily limits and maintaining professional conduct.

4. User Accounts & Security

• Registration: You must provide accurate information when creating an account.
• Security: You are responsible for maintaining the confidentiality of your Pikeah login credentials.
• Authorized Use: You agree not to use Pikeah for any illegal purpose or to violate any local, state, or international laws.

5. Subscription & Fees

• Early Access (Free Plan): Pikeah is currently offered for free during our early-access phase.
• Permanent Free Tier: We commit to offering a free-tier version of the Service indefinitely, though features within this tier are subject to change.
• Future Paid Plans: Pikeah reserves the right to introduce paid “Pro” or “Team” tiers. Existing users will be notified 30 days in advance of any changes that would require payment for previously free features.

6. Fair Use Policy (Free Plan)

To ensure stability for all users, our free plan is subject to “Fair Use” limits. This includes, but is not limited to:

• Reasonable daily limits on automated messages and connection requests.
• System-enforced delays to protect the integrity of our platform and your LinkedIn profile.
• Pikeah reserves the right to temporarily suspend accounts that exhibit bot-like behavior that exceeds these fair-use thresholds.

7. User Content & Data Ownership

• Your Data: You retain full ownership of the lead data you capture and the messages you write.
• AI-Generated Content: When using our “AI Campaign Generator,” the resulting drafts are provided for your use. While you own the final edited version of these messages, the underlying AI logic and templates remain the property of Pikeah.
• License to Pikeah: You grant Pikeah a limited, non-exclusive license to host and store your data solely to provide the Service to you.

8. Prohibited Conduct

You agree not to:

• Use the Service to send “spam” or unsolicited commercial content in violation of the CAN-SPAM Act.
• Reverse-engineer, decompile, or attempt to extract the source code of the Pikeah extension.
• Use the Service to harass, threaten, or defraud other LinkedIn users.
• Attempt to bypass any technical limits or security measures of the Service.

9. Termination

• By You: You may stop using the Service and delete your account at any time.
• By Us: We reserve the right to suspend or terminate your access to Pikeah immediately if you violate these Terms or if your actions pose a security risk to our platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKEAH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

1. YOUR USE OR INABILITY TO USE THE SERVICE.
2. ANY ACTION TAKEN BY LINKEDIN AGAINST YOUR ACCOUNT.
3. ANY UNAUTHORIZED ACCESS TO YOUR DATA.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on our site and updating the “Last Updated” date.
